Online Account Access Functions

You may use CU@home to (a) transfer funds between your accounts or to another SLFCU account; (b) obtain account balances; (c) obtain transaction information for your accounts; and (d) obtain loan account balance information. These features are limited to the extent, and subject to the terms, noted below.

1. Your ability to transfer funds between certain accounts is limited by federal law and the Universal Disclosure and Member Handbook. Transfers made using CU@home are counted against the permissible number of transfers described in the Universal Disclosure and Member Handbook.

2. There may be a delay of at least one business day in transferring funds between your accounts. Except as provided in this Agreement, all CU@home transaction instructions received by 12:00 a.m. (midnight) Mountain Time (MT) will be completed that business day. Any instruction received after 12:00 a.m. (midnight) MT will be completed the next business day.

3. Transactional information for your accounts will be available from CU@home for a maximum of nine statement cycles from the date of inquiry.

Sandia Laboratory Federal Credit Union provides monthly account statements in either paper or electronic format. If you agree to receive your account statements electronically, paper statements will no longer be mailed to you. Please see the next section, Disclosures & Notices, regarding how your choice of notification format will apply to your accounts.

Your eStatements are available for viewing and printing on CU@home for 18 months from the statement date. After that time, you may request a paper copy of your statement by contacting SLFCU.

Fees may apply for paper statement copies that are retrieved by SLFCU.

eStatements & Disclosure Hardware & Software Requirements

The following hardware and software is required to access and retain your monthly account statements electronically:

· Monitor for viewing electronic information. The application looks best with a minimum 1024 x 768 resolution;

· A valid, current electronic mail address.

· Adobe Reader software, available for download at no cost at www.adobe.com.

In order to retain your statement, you must have a hard drive or other storage device to "Save" the file(s) to. Alternatively for retention, your statements may be printed utilizing a printer properly connected to the personal computer hardware or other device you use to access and view your statements.

Exclusion of Warranties

CU@home and related documentation are provided "as is" without any warranty of any particular kind either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.

Password Security

Your online password is required to access SLFCU’s CU@home and Bill Payment functions. You agree not to give or make available your password to any unauthorized individual. If you believe your password has been lost or stolen, someone has attempted to CU@home without your consent, your account(s) or loan accounts have been accessed, or someone has transferred money without your permission, you must notify SLFCU immediately (see Contact Information below). SLFCU does not maintain a record of your password. If you lose or forget your password, follow the forgotten password instructions on CU@home so you can choose a new password. Security questions must be answered correctly in order to change a forgotten password online.

Valid passwords are 6 to 32 characters in length and must include at least one uppercase letter, one lowercase letter and one number. Select special characters may also be included. Visit CU@home for a list of accepted characters. Your password should not be something that is easily guessed such as your name, children’s names, etc. You should not write down your password and store it near your computer.

SLFCU recommends that members protect their valuable financial information by using the most secure encryption possible, which is 128-bit encryption as of the writing of this Agreement. Although you may be able to use CU@home with browsers with lower encryption levels, SLFCU does not recommend doing so. By using CU@home, you acknowledge that SLFCU cannot and does not guarantee the security of information transmitted via the Internet and assume all risks associated with transmitting information and processing transactions via the Internet.

Your Liability for Unauthorized Payments

You could lose all the money in your account(s) plus your maximum overdraft line of credit, if any, through an unauthorized CU@home transaction or payment. Therefore, you should CONTACT SLFCU IMMEDIATELY if you believe your password or account number(s) has been accessed and/or someone has performed an unauthorized transaction from your account. Notifying SLFCU immediately by phone could minimize your possible losses. All member-owners of SLFCU benefit when unauthorized transaction losses are kept to a minimum. You must also change your online password, as soon as you realize that your existing password has been compromised, by following the change password option in CU@home under the Self Service section.

Telephoning us is the best way of keeping your possible loses down. If you notify SLFCU within two (2) business days, you can lose no more than $50 if someone used your password without permission. Your maximum liability will be $50. If you do not tell us within two (2) business days after you learn of the loss or theft of your password and/or account number(s), and we can prove we could have stopped someone from accessing your account(s) without your permission if you had notified us, then you could lose as much as $500. Also, should your statement show CU@home, transactions or payments that you did not make or authorize, please tell us immediately. If you do not tell us within 60 days after we sent you the first statement on which unauthorized activity appeared, you may not get back any of the money you lost after the 60-days if we can show that we could have stopped the unauthorized CU@home, transaction(s) or payment(s) if you had notified us in time.

You agree to assist SLFCU in its efforts to recover any funds that were transferred or paid without your permission or consent. Refer to the Electronic Fund Transfer Disclosure in your Sandia Laboratory FCU Universal Disclosure and Member Handbook.

Please note, any person whom you permit to use CU@home is considered your authorized user, and you are responsible for all of their transactions, even if they exceed the scope of permission you gave them to access your accounts.

Errors and Questions

In case of errors or questions about CU@home, transactions, or payments, you must notify us at once (see Contact Information below). We must hear from you no later than 60 days after we send you the first statement on which the problem or error appeared. For all errors, you must:

1. Tell us your name, account number(s), and address; and

2. Describe the error about which you are unsure, and explain as clearly as you can why you believe it is an error or why you need more information.

If you tell us orally, we may require that you send your dispute or question, in writing, within ten (10) business days.

We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate the complaint or question. If we decide to do this, we will re-credit your account within ten (10) business days for the amount you think is in error, so that you may have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not re-credit your account.

If we determine there was no error, we will mail you a written explanation within three (3) business days after we finish the investigation. You may ask for copies of documents that we used in our investigation. Refer to the SLFCU Electronic Fund Transfer Disclosure in your Sandia Laboratory FCU Universal Disclosure and Member Handbook for more information.

When you use CU@home to conduct transactions, the information you enter may be recorded. By using CU@home, you consent to such recording.

No Signature Required

When using CU@home to conduct transactions or to pay bills, you agree that the CU may debit your account to complete the transactions, pay bills, or honor debits you have not signed.

Disclosure of Account Information to Third Parties

With respect to CU@home transactions, we will disclose information to third parties about your account, your transaction(s) or the payment(s) you make only in the following situations:

1. Where it is necessary for completing CU@home, transactions or bill payments;

2. In order to verify the existence and condition of your account(s) to a third party, such as a credit bureau;

3. In order to comply with laws, government agency rules or orders, court orders, or officials having legal authority to request such information;

4. If SLFCU has entered into an agreement to have another party provide CU@home; or

5. If you give us your written permission.

Please refer to the SLFCU Privacy Policy for more information about our maintenance of the security of your financial information.

You will not be charged to view accounts or transfer funds between your account or to transfer funds to other SLFCU Accounts using CU@home. Charges may apply to transfer funds to other institutions, even your own account at another financial institution. Refer to an SLFCU Fee Schedule for details. Fees are subject to change. NOTE: Your accounts and loan accounts are still subject to the fees, charges, balance requirements, etc. as described in the Deposit Agreement and Loan Agreement.

Alterations and Amendments

The terms of this Agreement, applicable fees, and service charges may be altered or amended by SLFCU from time to time. In such event, SLFCU shall send notice to you at your address (or electronic address if you agreed to receive communications in such manner) as it appears on SLFCU’s records. If you do not ask us in writing to discontinue the related service, you are deemed to have agreed to the change in terms. Further, SLFCU may, from time to time, revise or update the SLFCU program, services, and/or related material(s) rendering such prior versions obsolete. Consequently, SLFCU reserves the right to terminate this Agreement as to all such prior versions of the SLFCU programs, services, and/or related material(s) and limit access to SLFCU’s more recent versions and updates.

Address Changes

You agree to promptly notify SLFCU, in writing, of any address change.

Termination or Discontinuation

CU@home access may be terminated by the CU if your account is not accessed through CU@home for six months or more. However, any CU@home, transactions or payments you have previously authorized will be completed as instructed. Neither termination nor discontinuation shall affect your liability or obligation under this Agreement.

Payee Limitation

SLFCU reserves the right to impose a frequency or dollar limit on, or refuse to make, any payment you have directed. SLFCU is obligated to notify you promptly if it decides to refuse to complete your payment instruction. This notification is not required if you attempt to make payments that are prohibited under this Agreement.

In the event of a dispute regarding CU@home, you and SLFCU agree to resolve the dispute by looking to this Agreement. You agree that this Agreement is the complete and exclusive statement of the agreement between you and SLFCU, which supersedes any proposal or prior agreement, oral or written, and any other communications between you and SLFCU relating to the subject matter of this Agreement. If there is a conflict between what one of SLFCU’s employees says and the terms of this Agreement, the terms of this Agreement shall control.

You may not assign this Agreement to any other party. SLFCU may assign this Agreement to any present or future, directly or indirectly, affiliated company. SLFCU may also assign or delegate certain of its rights and responsibilities under this Agreement to independent contractors or other third parties.

No Waiver

SLFCU shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by SLFCU. No delay or omission on the part of SLFCU in exercising any right or remedy shall operate as a waiver of such right or remedy or any other rights or remedies. A waiver on any particular occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.

Our Liability for Failure to Complete Your Transactions

If we do not complete a CU@home transaction or BillPayer payment on time or in the correct amount according to this Agreement, we will be liable for your direct losses or damages. However, there are some exceptions. We will not be liable, for instance, if

(a)   through no fault of ours, you do not have enough money or available overdraft protection to complete the transaction;

(b)   the CU@home system is not working properly and you know about the problem when you initiate the transaction;

(c)   circumstances beyond our reasonable control (such as fire or flood) prevent the transfer in spite of our reasonable precautions;

(d)   other circumstances explained in this Agreement arise.

In no event will we be liable for indirect, consequential or punitive damages.

Meeting Your Obligations

All owners of the accounts linked to CU@home are individually and jointly responsible for meeting the terms of this Agreement. If your use of CU@home results in your becoming indebted to the Credit Union, you agree to pay what you owe us upon our demand. If you do not do so, you agree to pay reasonable collection costs we incur before taking legal action against you. If we take legal action to collect what you owe, you agree to pay our reasonable attorneys fees and court costs in addition to any other remedy the court finds proper.

Business Days

SLFCU’s business days are Monday through Friday excluding federal holidays.

The captions of sections hereof are for convenience only and shall not control or affect the meaning or construction of any of the provisions of this Agreement.
